Job Description

Our client is seeking a Compliance Legal Advisor for their team in Bloemfontein. Location: Bloemfontein Requirements: LLB Degree Admission as an attorney is required Advantageous Post-Grad diploma or LLM in a related field 3 yrs post-qualification experience Experience in commercial law, contract law, labour law, compliance, and regulatory matters. Familiarity with South African legal frameworks and relevant legislation (e.g., Companies Act, Labour Relations Act, POPIA, PAIA, B-BBEE Act, etc.). Computer literacy About: Legal Functions A primary focus on ensuring that the Group of Companies' operations, both in South Africa and internationally, comply with legal and regulatory requirements while mitigating risks and promoting ethical business practices. This involves exercising independent discretion and sound judgment in applying legislation. Vetting, drafting, and negotiating legal agreements and corporate law matters across multiple disciplines, while providing expert advice and ensuring the thorough implementation of the Group of Companies terms and conditions in all relevant details. Preparing and formulating legal opinions, memoranda, briefing documents, and formalities regarding resolving disputes, counselling promptly, obtaining relevant approval and managing instructions to external attorneys and/or authorities. Drafting, reviewing, and updating agreements, internal policies and procedures to ensure alignment with regulatory requirements while advising management on changes in financial regulations and their impact on business operations. Proactively preventing legal and regulatory violations that could result in fines, reputational damage, or sanctions. Ensure the implementation of internal controls to prevent regulatory breaches and legal issues. Conducting compliance risk assessments to identify potential regulatory risks and recommending effective mitigation strategies. Developing and delivering training programs to educate employees on compliance policies, regulatory changes, and ethical standards, fostering a strong culture of compliance. Collaborating with legal, risk and other colleagues to ensure seamless compliance operations. Proactively conduct independent analysis and research on legal matters and regulatory compliance legislation within your primary focus area, providing informed advice on the optimal legal position for various resolutions. Maintaining professional conduct by ensuring legal compliance in business and international trade matters while implementing effective risk management and mitigation measures. Ensure absolute confidentiality in handling the Group of Companies' information acquired through transactions, agreements, legal documentation and inquiries. Leverage all available resources to their fullest capacity and potential. Implement systems and procedures to effectively record and manage all critical aspects within a multidisciplinary practice, ensuring adherence to tight deadlines in your primary focus area. Participate in litigation meetings as scheduled by the director or senior management, at times and venues determined periodically. Conduct credit searches for risk assessments, ensuring adherence to regulations and policies, and assisting with the vetting of deal terms and conditions. Proactive risk management and debt recovery on assigned Group Company exposure. Furthermore Reporting daily to relevant role players concerning any aspect that may have a bearing on the projected settlement concerning regulatory compliance and/or disputes. Drafting of weekly/monthly litigation, collection, risk and compliance reports in the prescribed Group of Companies format. Submitting detailed planning reports concerning all legal difficulties and schedules for the subsequent week and/or month. Rendering professional support as a legal representative and liaising with the Board of Directors, senior management and colleagues regarding various subjects to ensure the ability to address any troubleshooting issues that may arise proactively. Liaising with the Board of Directors and senior management to regulate the external recovery of outstanding payments from debtors, damages, and legal costs, you are specifically required to take ownership and accountability for the proper execution of any ad-hoc projects. Ensuring strict adherence to the Group of Companies protocol on policies, procedures and applicable legal governing business operations directed in South Africa and internationally. Record keeping of Credit Committee meetings by documenting key discussions and action points, transcribing and typing up minutes, preparing minutes for approval and maintaining a filing system
